Hi all,
My wife is on F-1 Visa and is planning to graduate in Dec 07. I have applied for I-485 for both of us in last week of July. Can she Under-Enroll for Fall 2007 as that will be her graduating semester?
I understand that once I-485 is filed, the F-1 Visa candidate cannot make any F-1 related changed (transfer, extend, OPT) since that person has shown immigration intent. What about under enrollment in graduating semester? My wife called her school and they said that they have to internally approve her under enrollment by looking at her Plan of Study, graduation application etc.. The approval is given internally and INS is not involved in the approval process. It�s just that after the approval, the school has to inform INS about what they did.
Does it mean, it�s Okay to under enroll? Any inputs on this will be appreciated.

I entered in USA on H1B with Company A. Transferred H1B from A to B and B to C in last three years. Currently I am working for Company 'C' and my green card file was filed in Company 'D' in Year 2004.Labour and I140 approved and I485 filed and pending as part of Green card processing with Company 'D'(EB-3 category).I have never worked for Company 'D'. Not even spent single day at Company D. Now, Company D is suffering from 2008-2009 worst recessions and about to get close in one month. They already informed me. What are the options to get green card with as less risk as possible?
Please accept my appreciation and thank you in advance for your time that you will spent to help me on this issue.

Can I send my daughter to India for an year without having reentry permit?(she has greencard) (or) what is the maximum period children can stay out of US after getting greencard?

Hi Guys,
I was reading another thread and a question came to my mind..
I entered in US on AP and got the I-94 with the validity date as my AP date. Now my AP is going to expire and I am not going to travel anywhere any time this year. So just wondering what will happen when the I-94 is expired. Do I have to get it renewed from somewhere or just dun worry about it. or do I have to apply for a new AP.
Can anyone can shed some light on this situation?
I am in the same situation. I thought that I will get new I-94 but not. My lawyer says that keep EAD and Dr. Lic with me all time in case I need to prove that I am legal ....

Very few members are intrested in discussing H1B as most IV members are on EAD.
Thats not true. There are equal number of people who have EAD and still keep their H1 for some reason.

I am in the same boat. Filed July 19th . As of Last Friday not in the system.
No checks cleared. All the guys who filed with me got their receipt last week from Texas. I am the only one remaining. My I140 was approved from NSC.

May be it is worth it or may be not....In www.cnn.com there is a section (on the left hand side) asking what the democrats should do first. (They are basically asking our opinion)
I wrote down some items that I thought they should discuss, namely, in the area of legal immigration relief for EB categories.
We probably wont gain anything out of it; at the same time, it doesnt hurt to send them our opinion.

A startup in the area filed for my PERM and it was approved in June 2010. Right now, they are in a mess about their tax returns and reauditing with their CPA and it seems that they will not be able to provide tax statements for this year end.
That will cause the PERM to expire without filing I140 since PERM expires in Dec. Is there anyway for us to file extension for the PERM ? More than 180 days...
I think they should still be able to file your I-140 in regular processing by not including the latest tax papers (include previous years). Since it takes a few months to process I-140 under regular filing, they will likely issue an RFE asking for tax documents. Hopefully, by then they are done with their audit and would be able to reply to the RFE with tax documents or provide explanation on why they cannot provide the requested documents but they can provide any other document that proves their ability to pay. That way, you won't lose your approved PERM.
